1. Acceptance of Terms

Welcome to PsycleBack! By accessing or using our website and mobile app (the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use our Services.

2. Definitions

  • "Finder" — A user who lists and sells secondhand items on PsycleBack.
  • "Buyer" — A user who purchases items from Finders.
  • "Listing" — An item posted for sale by a Finder.
  • "We," "us," "our" — PsycleBack and its operators.

3. Eligibility

You must be at least 13 years old to use PsycleBack. Users under 18 must have parental or guardian consent. By using our Services, you represent that you meet these requirements.

4. Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Keep your password secure and confidential
  • Notify us immediately of unauthorized access
  • Be responsible for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Finder Responsibilities

As a Finder, you agree to:

  • Accurately describe items (condition, brand, size, flaws)
  • Use your own photos (no stock images or misleading representations)
  • Set fair prices and honor your listings
  • Ship items promptly (within 3 business days unless otherwise stated)
  • Respond to buyer inquiries in a timely manner
  • Not list prohibited items (see Section 7)

6. Buyer Responsibilities

As a Buyer, you agree to:

  • Pay for items you purchase
  • Provide accurate shipping information
  • Communicate respectfully with Finders
  • Not abuse return or refund policies

7. Prohibited Items and Conduct

You may not list, sell, or purchase:

  • Counterfeit or replica items
  • Stolen goods
  • Items that violate intellectual property rights
  • Weapons, drugs, or illegal items
  • Hazardous or unsafe materials

You may not:

  • Harass, threaten, or abuse other users
  • Post spam, fraudulent content, or misleading information
  • Use automated tools (bots, scrapers) without permission
  • Circumvent payment systems or fees
  • Impersonate others or misrepresent your identity

8. Payments and Fees

8.1 Payment Processing

All payments are processed securely through Stripe. PsycleBack does not store your credit card information. By purchasing items, you agree to Stripe's terms of service.

8.2 Fees

PsycleBack may charge fees for certain transactions (e.g., seller fees, transaction fees). These fees will be clearly disclosed before you complete a transaction.

8.3 Refunds and Returns

Refunds and returns are handled between Buyers and Finders. PsycleBack is not responsible for disputes, but we may assist in resolution at our discretion.

9. Shipping

Finders are responsible for:

  • Packaging items securely
  • Shipping items within the stated timeframe
  • Providing tracking information when available

PsycleBack is not responsible for lost, damaged, or delayed shipments. We recommend purchasing shipping insurance for high-value items.

10. Intellectual Property

All content on PsycleBack (logos, text, graphics, design) is owned by or licensed to PsycleBack and protected by copyright and trademark laws. You may not use our content without permission.

By posting content (photos, descriptions, reviews), you grant PsycleBack a worldwide, non-exclusive, royalty-free license to use, display, and promote your content in connection with our Services.

11. User Content

You are responsible for all content you post. You represent that you own or have the rights to the content you share. PsycleBack may remove content that violates these Terms or is otherwise objectionable.

12. Disclaimer of Warranties

PsycleBack is provided "as is" and "as available." We make no warranties, express or implied, about the reliability, accuracy, or availability of our Services. We do not guarantee that:

  • The Services will be uninterrupted or error-free
  • Items listed are accurately described or authentic
  • Transactions will be completed successfully

13. Limitation of Liability

To the fullest extent permitted by law, PsycleBack and its operators, employees, and partners are not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or use
  • Disputes between users
  • Unauthorized access to your account
  • Errors, bugs, or interruptions in service

Our total liability for any claim related to these Terms or our Services shall not exceed $100 USD or the amount you paid to PsycleBack in the past 12 months, whichever is greater.

14. Indemnification

You agree to indemnify and hold harmless PsycleBack from any claims, damages, or expenses (including legal fees) arising from:

  • Your use of our Services
  • Violation of these Terms
  • Content you post
  • Transactions with other users

15. Termination

We may suspend or terminate your account at any time for violating these Terms or for any other reason, with or without notice. You may also delete your account at any time from your Account Settings.

Upon termination, your right to use the Services ceases immediately. Sections that by their nature should survive (e.g., payment obligations, disclaimers, indemnification) will remain in effect.

16. Dispute Resolution

Any disputes arising from these Terms or your use of PsycleBack shall be resolved through binding arbitration under the rules of the American Arbitration Association. You waive your right to a jury trial or to participate in a class action.

If arbitration is not enforceable, disputes shall be resolved in the state and federal courts located in the United States, and you consent to the jurisdiction of those courts.

17. Governing Law

These Terms are governed by the laws of the United States and the state in which PsycleBack is registered, without regard to conflict of law principles.

18. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the new Terms on this page and updating the effective date. Continued use of our Services after changes constitutes acceptance of the updated Terms.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
